These are the Terms and Conditions governing the use of this Service and the agreement that operates between the “You” and the “otw – On the way”. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Services. If you disagree with any part of these Terms and Conditions then you may not access the Service. You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.
1. USER ACCOUNT1.1 When You create an account with Us, You must provide your identity card according to our required ID’s. Failure to do so, you may not access the Service; 1.2 User account may only select suggested username upon registering to the Service, and it is not editable in the proceeding; 1.3 Registering to our Service is limited to one account for every device, you may not use the same device if you wish to create another account; 1.4 You will provide true, accurate, not misleading, current and complete information as required for the Service and undertake the responsibility to maintain and update your information in a timely manner to keep it true, accurate, not misleading, current and complete at all times during the term of the Agreement; 1.5 You will only use the Service for their intended and lawful purposes; 1.6 You agree to assist “the Company” with any internal or external investigations as may be required in complying with any prevailing laws or regulations in place; 1.7 You will not authorize others to use your identity or user status, and you may not assign or otherwise transfer your user account to any other person or entity; 1.8 You agree to notify us immediately of any unauthorized use of your account or any other breach of security; 1.9 You agree that “the Company” may restrict or deactivate your account if there has no transaction made by you on your user account for a period of three (3) months from the last date of transaction. 1.10 User account may only limit for three cancellations every day, if reach the maximum it is subjected for account suspension or temporary restriction.
2. SERVICES 2.1 “otw – On the way” is a mobile application system that you can book your desired transaction using your mobile devices. The services may include, but not limited to; “Food delivery”, “Parcel Delivery”, and “Ride-Sharing Services”; 2.2 The Service may display advertisement in the application. 3. PARTNER RIDER Our Service grant you an exclusive right to perform the Services of “otw – On the way”. The performance of these Services may include but not limited to; “Food Delivery”, “Parcel Delivery”, and “Ride-Sharing Services”. By registering to Us, you agree to our “Partner Rider Agreement” that may include, but not limited to; 3.1 Operational partner rider guidelines; 3.2 Fare Matrix; 3.3 Commissions; 3.4 Insurance policy. 4. PAYMENT & REFUND POLICY 4.1 All the charges of Service will be promptly displayed before the proceeding of the transaction; 4.2 User is entitled to get a 2% cash back for every booking they made through the application; 4.3 Each point is equivalent to a one peso; 4.4 Accumulated points can use as payment for the Service. 4.5 Payment Terms All services provided by us must be paid for and the corresponding amount will be deducted from the user's wallet. 4.6 Top-Up Disputes In the event of a dispute arising from a top-up transaction made via any third-party provider due to technical issues, we will credit the disputed amount to the user’s wallet with 3-4 business days. To process this, the user must provide proof of transaction, such as a reference number or detailed transaction information. 4.7 Withdrawal and Account Deletion Users are not allowed to withdraw the entire balance of their wallet if they decide to delete their account. However, the balance can be transferred to a newly created account. To facilitate this transfer, the user must provide the previous wallet user ID. 5. ACCOUNT SUSPENSION AND TERMINATION We want “otw – On the way” to be a platform where users and our third-party providers engage on a manner that benefited each other. We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. Upon termination, your right to use the Service will cease immediately. If You wish to terminate Your Account, you may simply discontinue using the Service 6. CHANGES TO THESE TERMS AND CONDITIONS We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material,we will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion. By continuing to access or use Our Service after those revisions become effective, You agree to be boundby the revised terms.
